Divorce versus Mediation

Divorcing couples can use different mechanisms to separate. Divorce litigation involves each spouse working with an attorney to work out details, such as asset distribution, custody, spousal support, and other logistics. Mediation involves both parties using an objective third party, known as a mediator, to settle aspects of the split in a facilitated way.

Statistics suggest that mediation can be cheaper than litigation and shorter. One authority says mediation takes about an average of three to six months – although this can depend on the circumstances of the couple (such as number of children, amount of assets in the bank, etc.); whereas divorce litigation may average around two years.

In mediation, no legal advice is given (although both parties will receive legal information). Statistics suggest that couples who go through mediation tend to do better with voluntary compliance with child support arrangements – although this may be a function of who chooses to go through mediation (as opposed to a function of the efficacy of the mediation itself).

Many people choose mediation because clients can be more involved in the decision-making process about child custody, asset disbursal, etc. In formal litigation, lawyers and judges make many decisions that will impact your life. Mediation is also more confidential. Divorce hearings can be public, and information about your finances will go onto the public record.

Mediation is probably not the "panacea" its most vocal advocates say it is. In certain situations, either or both parties may benefit from a more formal legal process. But mediation can be an effective choice for some couples, particularly couples who want an amicable, reasonable divorce and who have some trust in each other's ethics and ability to implement decisions.
